CONFIRMATION OF RESERVATION: Payment of the initial reservation charge confirms your acceptance of these Terms and Conditions. We reserve the right to cancel a reservation at our discretion if we suspect that the information provided is false or incomplete. You agree to indemnify and hold us harmless from any liability, loss, damage, cost, or expense resulting from your acceptance of this reservation. These terms and conditions are governed by the laws of the State of California. If we make the reservation for you, you will receive a confirmation email containing a link to these terms and conditions. By making the reservation, you accept these terms and conditions.

PAYMENT: For short-term stays, payment for your reservation can be made by Visa, Mastercard, or American Express. All reservations require a credit card on file. Fifty percent of the total cost is due to reserve the property, and the balance is due 30 days before the check-in date. Once we approve your reservation, we will charge your credit card automatically based on the payment terms. For long-term stays, payment must be made by ACH or personal check.

CANCELLATION AND/OR RESERVATION CHANGES: If you cancel 60 or more days before the arrival date, the full amount of the stay's cost is refundable. If you cancel between 30 and 60 days before the arrival date, 50% of the cost of the stay is refundable. No refunds are available for cancellations made less than 30 days before the arrival date. The credit card processing fee is not refundable.

LONG-TERM RENTAL POLICY: The Long-Term Rental Payment Policy applies to all reservations of 30 nights or more. A non-refundable deposit of 10% of the total cost is required to reserve the property. An additional 40% of the total cost is due at least 120 days before the check-in date, and the remaining 50% is due at least 90 days before the check-in date, both of which are non-refundable once paid. If you cancel more than 90 days before the arrival date, 50% of the total cost of the stay is refundable. No refunds are available for cancellations made less than 90 days before the arrival date.

 MINIMUM AGE 21: Only persons 21 years of age or older may occupy a property unless accompanied by someone who is at least 21 years old.

CHECK-IN AND CHECK-OUT: Check-in is after 4:00 PM, and check-out is before 11:00 AM. Front door codes are not operational until 4:00 PM. Early check-in and late check-out are not allowed without prior agreement, and a late check-out fee may apply. The reserving party must be present for check-in and provide valid government-issued identification or a passport matching the credit card payment. The entry code will be granted after verification.

OCCUPANCY OF UNIT: The reservation party is responsible for ensuring that the maximum number of occupants allowed by the City of Carlsbad's ordinances does not exceed the unit's capacity. Furthermore, the reservation party must ensure that all occupants and guests comply with the terms and conditions set forth in this agreement and abide by all applicable laws. Failure to comply with these provisions will result in immediate termination of the occupancy without any refund. Please note that parties, special events, and weddings are strictly prohibited in or around the unit or common areas. Additionally, the reservation party is responsible for maintaining the condition of the unit and any damages caused during their stay.

GARBAGE DISPOSAL: Toilet, and Sinks: To prevent plumbing issues, please only use toilet paper in the toilet. We kindly ask you not to dispose of peelings or fibrous materials through the disposal.SECURITY DEPOSIT/DAMAGE INSURANCE: A damage deposit of $500 is required at the time of booking. This amount will be refunded within seven days after departure, provided that there are no missing items or damages caused by the reserving party, occupants, or guests. If any missing items or damages occur, they will be charged to the booking party's credit card.

RATE CHANGES: Rates may change without notice. However, confirmed booking rates will be honored for the reserved stay. Additional nights are subject to market rates and availability.

PARKING: Each unit has one designated parking space. Please park only in the assigned space.

NON-SMOKING POLICY: Smoking is strictly prohibited anywhere on the property. A $250 fee will be charged to the credit card on file or deducted from the damage deposit for any smoke smell/odor in the unit.PET POLICY: Pets are not allowed anywhere on the property, except for bona fide service animals. If a service animal will occupy the unit, a copy of appropriate documentation must be provided. If there is any evidence of pet hair or pet odor in the unit, an additional $200 cleaning fee will be charged to the credit card on file or deducted from the damage deposit.

FIRE PIT: The Fire Pit in the courtyard is a non-vented gas-fired unit. Please refrain from throwing any paper or combustible materials into the fire pit. Children should not be near the fire pit without adult supervision. The fire pit pebbles and glasses should not be removed from the fire pit. Children are not allowed to be in or around the fire pit area without adult supervision.

NOISE ORDINANCES: All occupants and guests must comply with the noise ordinances of the City of Carlsbad. Noise ordinances come into effect at 10:00 pm, which include loud music, loud voices, or other loud sounds. If the occupants or guests disturb the peace or violate any noise ordinances, we reserve the right to terminate occupancy immediately, and no refund will be provided.

SWIMMING POOL HOURS: The swimming pool is open from 8 AM to 9 PM. Please note that the use of the pool is at the occupants' and registered guests' own risk. Pool use is restricted to registered occupants and approved guests only. Children must be supervised by an adult at all times while in the pool area. Please be advised that diving, beach, or sand toys are not allowed in the pool, and throwing of balls, toys, or running is prohibited in the pool/hot tub area. Additionally, glass is not permitted in the pool/hot tub area.

Please note that the property management company is not responsible for personal belongings left behind on the property. If you request us to package and return any items left on the property, a $25 service fee and shipping costs will be billed to your credit card.Owners are not responsible for accidents, injuries, death, claims, damages, or loss of personal belongings on the property or amenities. Reserving party, occupants, and guests must indemnify, defend, and hold harmless the owners against liabilities, injuries, claims, expenses, loss of use, damages, or actions arising from the use of the Unit and amenities. Owners are not liable for theft, vandalism, or damage to guest property or vehicle.

FURNITURE AND ACCESSORY: Furniture must remain in the Unit, and equipment provided by the owners should be used for its intended purpose only. If any furniture or accessory is lost, damaged, or stolen, the reserving party will be charged for the replacement value. An inventory will be taken before and after each stay, and any equipment failure must be notified immediately for repair. The owners are not responsible for any damage resulting from lack of maintenance, cleanliness, repairs, or property defects. In the event of maintenance or repairs, service technicians may require access to the Unit.

ACT OF GOD: Occupants acknowledge that their vacation stay may be scheduled during undesirable weather or an Act of God. In such events, we will not be responsible for any refunds, preparation of the Unit, or providing lodging elsewhere. In the event of an evacuation, occupants must comply immediately. Any unused portion of the reservation due to early departure or termination is non-refundable. We will not be responsible for any refunds, preparation of the Unit, or providing lodging elsewhere in the event of an Act of God.Failure to comply with these Terms and Conditions or California Law will result in the termination of your occupancy without a refund. This agreement is governed by the laws of the State of California, and we reserve the right to enter the unit at any time. While the information provided on our website is accurate to the best of our knowledge, it is for guidance purposes only and does not form part of this Terms and Conditions Agreement.Please note that the prevailing party in any lawsuit to enforce or interpret this agreement, or relating to arising out of this Agreement, the guest reservation, guest stay and use of the Unit, or any amenities provided with said Unit shall be entitled to attorney fees and all court costs and expenses. This agreement contains the entire agreement between the parties and may only be changed in writing and signed by both parties. Renters cannot assign or transfer this agreement.
